HairyArse over at http://www.allaboutthegames.net has found a do it yourself fix for the guitar. Instead of sending your faulty guitar back, you can fix it, and not void the warranty. It is a very painless, and easy fix.
The problem is isolated to two specific models of the controller, the numbers of which are 95065 and 95055. You can find out what model you have, by viewing the product sticker on the back of the guitar.
The fix is just adjusting the whammy bar sensor. As seen in this picture.
